# Portugal's Return Law: Court Clearance and Presidential Promulgation

## The short answer

On 28 August 2026 Portugal's Constitutional Court decided, unanimously, not to declare any of the 11 challenged rules of the new asylum-and-return law unconstitutional. President António José Seguro promulgated the diploma on 31 August 2026. This article does not establish the date the final published text takes effect; check the Diário da República and its commencement clause before relying on it. Once in force, it would raise maximum immigration detention from 60 to 180 days (extendable to 360) and speed up removal procedures. It targets people in removal or asylum proceedings — a valid residence permit or visa is not what this law is about.

On Friday **28 August 2026**, Portugal's Constitutional Court decided — unanimously — not to declare any of the **11 challenged rules** of the new asylum-and-return law unconstitutional. If that headline reached you as "Portugal's deportation law is now in force", here is the clearer picture: it is not aimed at people who hold a valid visa or residence permit, and this article does not establish whether the final text has entered into force. ## What did the Constitutional Court decide?

The court answered the specific request the president filed on **7 August 2026**: a *fiscalização preventiva* — a preventive constitutional review, before a law can enter into force — of 11 rules in the decree parliament approved in July. His doubts centred on the separation of parents from children and the expulsion of minors, on administrative detention of people who have committed no crime, and on appeals losing their suspensive effect, meaning someone could be removed before a court had ruled on their case.

On 28 August the judges decided, in the court's own formula, "not to pronounce the unconstitutionality" of any of the 11 rules. The decision was unanimous.

Two limits sit inside that sentence. The court answered the 11 questions it was asked — it did not certify every line of the law. And clearing the constitutional check does not enact anything: a decree without a presidential signature is still just a decree.

The verdict is also a reversal of recent history. In **August 2025**, reviewing the previous immigration amendment, the same court — with a different bench — struck down five of the seven rules it examined, on family reunification and limits to court appeals. Four new judges joined the court in June 2026. This time, all 11 rules survived.

## What is Portugal's 'return law'?

"Return law" (*lei do retorno*) is the press shorthand for a parliamentary decree that rewrites two regimes at once: the rules on entry, stay and removal of foreign nationals, and the rules on asylum. Parliament passed it on **17 July 2026** with the votes of PSD, IL and CDS-PP; PS, Livre, PCP, BE, PAN and JPP voted against, and Chega abstained.

By the government's own description, the law's core is speed: removal decisions that currently go unexecuted — Portugal completed roughly **5%** of ordered returns through 2023, on the government's figures — should be carried out faster. To get there, the decree changes the machinery:

- **Detention gets longer.** The maximum stay in a *centro de instalação temporária* — a temporary installation centre, where foreign nationals can be held pending removal — rises from **60 to 180 days**, extendable up to **360 days** where the person does not cooperate with identification or documentation.
- **Alternatives to detention are written in**: bail, surrendering travel documents, or residing in a centre under an open regime.
- **Asylum and appeal procedures tighten**, including cases where challenging a decision no longer suspends it — the point the president flagged hardest.

The government presented the package on 15 May 2026 as the final piece of the immigration overhaul it began in 2024, aligned with EU asylum and return rules. - **You hold a valid residence permit, or are applying for a visa from abroad.** This law is not about you — it governs removal and asylum procedures. This article does not establish when the final text takes effect; once it does, detention periods, appeal effects and timelines change. ## What happens next, and when?

The decree is signed. On **31 August 2026** President António José Seguro [promulgated the diploma](https://www.presidencia.pt/atualidade/toda-a-atualidade/2026/08/presidente-da-republica-promulga-lei-de-estrangeiros-e-de-concessao-de-asilo/), closing the window under **article 136 of the Constitution** to return it to parliament with a political veto.

That is not the same as the law taking effect. Promulgation authorises publication; it does not itself set a start date for enforcement. This article does not establish the diploma's Diário da República publication act or its commencement date.
